Acceptable Use Policy

1. Purpose and Scope
This Acceptable Use Policy ("AUP") governs the use of all services provided by ExtenX, including our virtual business phone system, cloud telephony infrastructure, SMS messaging capabilities, AI-powered features, and all related tools and services (collectively, the "Services").
This AUP is incorporated by reference into ExtenX's Terms of Use and applies to all users, account holders, employees, contractors, agents, and any other individuals or entities who access or use the Services ("Users").
ExtenX's Services are intended solely for lawful business communication purposes. Any use of the Services to facilitate illegal, abusive, fraudulent, or harmful activity is strictly prohibited and may result in immediate account suspension, termination, and referral to law enforcement authorities.
2. General Use Requirements
All Users must:
- Use the Services only for lawful purposes and in compliance with all applicable local, state, federal, and international laws and regulations;
- Maintain accurate account information and not misrepresent their identity, business, or intended use;
- Take reasonable steps to prevent unauthorized use of their accounts;
- Promptly report any known or suspected misuse of the Services to ExtenX;
- Comply with all telecom regulations applicable to their communications, including TCPA, CAN-SPAM, the TRACED Act, and applicable carrier guidelines;
- Comply with ExtenX's SMS Messaging Policy when using A2P messaging features.
3. Prohibited Uses — Telecom and Communications Abuse
The following telephony and communications activities are strictly prohibited:
Robocalling
Using automated dialing equipment or pre-recorded voice messages to contact mobile or residential phone lines without prior express written consent, in violation of the TCPA or applicable state law.
Caller ID Spoofing
Transmitting false or misleading caller identification information with the intent to defraud, cause harm, or wrongly obtain anything of value, in violation of the Truth in Caller ID Act or applicable law.
Telemarketing Violations
Conducting outbound telemarketing campaigns in violation of the FTC's Telemarketing Sales Rule (TSR), Do-Not-Call (DNC) registry requirements, or applicable state telemarketing laws.
Call Flooding / Denial of Service
Placing excessive or repetitive calls to individuals or businesses for the purpose of harassment, disruption, or denial of service.
Illegal Wiretapping or Interception
Intercepting, recording, or monitoring communications without the legally required consent of all parties, in violation of the Electronic Communications Privacy Act, California Invasion of Privacy Act, or other applicable wiretapping laws.
Phone Fraud
Using the Services to facilitate phone fraud, including but not limited to IRS impersonation scams, Social Security fraud, tech support scams, or other fraudulent schemes.
4. Prohibited Uses — SMS and Messaging Abuse
The following SMS and messaging activities are strictly prohibited:
Spam
Sending unsolicited commercial messages (spam) to individuals who have not provided prior express consent to receive such messages.
Smishing
Sending fraudulent or phishing SMS messages designed to deceive recipients into providing sensitive personal, financial, or account information.
Unregistered A2P Campaigns
Sending Application-to-Person (A2P) SMS messages without proper registration with The Campaign Registry (TCR) and compliance with carrier A2P 10DLC requirements.
Ignoring Opt-Outs
Failing to promptly honor opt-out requests (e.g., STOP requests) from message recipients as required by applicable law and carrier guidelines.
SHAFT Content
Sending SMS messages containing content related to Sex, Hate, Alcohol, Firearms, or Tobacco to the extent prohibited by carrier guidelines or applicable law, including content that is sexually explicit, promotes hate speech, or advertises age-restricted products to unverified recipients.
High-Volume Unsolicited Blasting
Using ExtenX to send mass unsolicited messages, including but not limited to bulk marketing, political messaging, or survey campaigns, without proper consent, campaign registration, and opt-out mechanisms.
Carrier Bypass
Attempting to circumvent carrier filtering systems, A2P registration requirements, or any other carrier or regulatory compliance mechanism.
5. Prohibited Uses — Illegal and Harmful Activity
Users may not use the Services to facilitate, promote, or engage in:
- Any activity that violates applicable federal, state, local, or international law or regulation;
- Harassment, threats, intimidation, stalking, or abuse of any individual;
- Hate speech, discrimination, or content that promotes violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
- Distribution or promotion of illegal drugs, controlled substances, or drug paraphernalia;
- Illegal gambling, pyramid schemes, or fraudulent financial offers;
- Human trafficking, exploitation, or any related activity;
- Distribution of child sexual abuse material (CSAM) or any content that exploits minors;
- Identity theft, account takeover fraud, or unauthorized access to third-party accounts or systems;
- Unauthorized collection of personal data or violation of third-party privacy rights;
- Transmission of malware, viruses, or other malicious code via call, SMS, or voicemail;
- Impersonation of ExtenX, its employees, or any other person or entity;
- Export control violations, including providing the Services to sanctioned individuals, entities, or countries.
6. Prohibited Uses — AI Feature Misuse
ExtenX's AI-powered features, including missed-call auto-reply assistants, voicemail transcription, and AI-generated communications, may not be used to:
- Generate or distribute fraudulent, deceptive, or misleading communications;
- Impersonate real individuals, companies, or government agencies without authorization;
- Generate content that is discriminatory, harassing, threatening, or defamatory;
- Automate illegal telemarketing, robocalling, or spam campaigns;
- Circumvent carrier filtering or compliance requirements through AI-generated content variations;
- Create or distribute AI-generated content that violates any third party's intellectual property rights.
Reminder: AI-generated content sent through ExtenX is your content. You are responsible for ensuring all AI-assisted messages comply with this AUP and applicable law.
7. Customer Compliance Responsibilities
ExtenX is a platform provider. Customers are solely responsible for ensuring their use of the Services complies with all applicable laws and regulations. This includes, without limitation:
- Obtaining Consent: Customers must obtain all legally required consents from their contacts before sending SMS messages, making automated calls, or recording conversations.
- Campaign Registration: Customers are responsible for registering their SMS campaigns with TCR and maintaining compliance with A2P 10DLC requirements.
- Opt-Out Management: Customers are responsible for maintaining and honoring opt-out lists.
- Content Compliance: Customers are responsible for the legality and appropriateness of all content transmitted through the Services.
- Regulatory Compliance: Customers are responsible for compliance with TCPA, CAN-SPAM, TSR, applicable state laws, and carrier guidelines as they pertain to the customer's specific communications.
ExtenX does not assume any compliance responsibility on behalf of its customers and will not be liable for customer violations of applicable law.
8. Monitoring and Enforcement
ExtenX reserves the right, but is not obligated, to monitor use of the Services to detect and prevent violations of this AUP. We may use automated systems and human review to identify potentially non-compliant activity.
ExtenX may take action based on complaints from carriers, regulators, or third parties, as well as based on our own monitoring. We are not liable for any failure to detect or take action against AUP violations.

We take all reports seriously and will investigate reported violations promptly. Reports may be submitted anonymously.
10. Consequences of Violations
Violations of this AUP may result in:
- Immediate suspension or termination of your account without notice or refund;
- Removal of specific phone numbers or messaging capabilities;
- Reporting of violations to law enforcement, regulatory authorities, or telecommunications carriers;
- Legal action, including claims for damages, injunctive relief, or other remedies available under applicable law;
- Referral to The Campaign Registry (TCR) or other industry bodies for blacklisting.
ExtenX reserves the right to cooperate fully with law enforcement investigations and to disclose account information as required by law or as described in our Privacy Policy.
